Statute of Limitations
Nevada gives you 2 years from the date of the crash to file a drunk driving injury lawsuit (NRS 11.190). The criminal DUI case against the driver is separate and runs on its own timeline — your civil deadline still applies, so don't wait for the criminal case to finish.
Comparative Negligence
Nevada follows modified comparative negligence. If you are 51% or more at fault you recover nothing; otherwise your recovery is reduced by your share (NRS 41.141). In most DUI crashes, fault rests squarely with the impaired driver.
Punitive Damages
Because driving drunk is reckless, Nevada has a specific punitive-damages statute for DUI injury cases (NRS 42.010) — damages meant to punish the driver, beyond compensation for your losses. Unlike most punitive awards in Nevada, DUI punitive damages are not subject to the usual statutory cap. This is one important way a drunk driving case can differ from an ordinary accident claim.

Unlike many states, Nevada generally does not allow you to sue a bar, casino, or restaurant for serving an adult who later causes a DUI crash — the law places responsibility on the drinker (NRS 41.1305).
