Common Pedestrian Accident Questions

Do pedestrians always have the right of way in Nevada?

Not always — but in most situations involving a crosswalk, yes. Under NRS 484B.283, drivers must yield to pedestrians in marked and unmarked crosswalks. There are limits — a pedestrian can't suddenly leave a curb in front of a vehicle that can't stop — but the legal duty to look out for and yield to pedestrians falls squarely on the driver.

What if I was crossing outside a crosswalk?

You can still recover. Nevada uses modified comparative negligence, so being partly at fault reduces your recovery but doesn't bar it as long as you're 50% or less responsible. Drivers also still owe a duty of care to pedestrians outside crosswalks — they can't just hit you.

How long do I have to file a pedestrian accident claim in Nevada?

Two years from the date of the accident, under NRS 11.190. Wrongful-death actions also generally run two years. Don't wait — surveillance footage and witness memories fade fast, and claims against government entities can have much shorter notice deadlines.

What if the driver doesn't have enough insurance?
